Areas of Practice
Administrative Law
Administrative law is the area of law which deals with decisions made by different bodies and agencies which have been given powers by the government to regulate a certain area. This would include such things as professional discipline carried out by a self regulating professional body (e.g. the legal profession’s regulation through the Law Society), or boards which oversee certain types of benefits (e.g. Workers Compensation), or a regulatory body which has powers to regulate certain areas (e.g. the Island Regulatory and Appeals Commission.)
The personal injury lawyers at McLellan, Brennan are available to represent clients before these tribunals to ensure they are dealt with fairly. Also, if one of the decision-making boards comes to a decision which is not favourable to the client, our lawyers can commence a judicial review (e.g. an appeal) of the decision either in the Supreme Court or the Federal Court.
The lawyers at McLellan, Brennan are also experienced in giving advice to various of these tribunals in the roles of counsel to the tribunal, and in prosecuting matters before these boards.
